  1. IMPORTANT: This Competition is provided and organised solely by Our Vacation Centre Pty Ltd, and no other party is involved in the provision or organisation of this Competition.
  2. By participating in this competition, you agree to be bound by these Terms and Conditions (“Terms”). These Terms consists of the summary of competition details set out below (“Summary”), and the general terms and conditions (“General Terms and Conditions”) attached hereto as Schedule 1.
  3. The Summary and the General Terms and Conditions shall be taken as mutually explanatory of one another and shall be read and construed as a whole. In the event of any inconsistency or ambiguity between or within the documents forming part of this agreement, the terms of the Summary shall prevail.
  4. In the event that you do not accept the Terms or any part of the Terms, you must not participate in this competition.
  5. The Summary is set out in Table 1 below.

    5.2

    Competition Title

    Eligible Participants (each, a “Participant”)

    1. This Competition is not open to the public and is exclusive to Australia-resident members of the RCI Travel, RCI Exchange and RCI 241 subscribing membership held with Organiser. Residents of the Australian Capital Territory are not eligible to join this Competition.

    2. If Participant stops being a member of Organiser (as described in 4.1) above) at any time before the delivery of the Prize, Participant shall be disqualified from the Competition.

    5.4

    Maximum Number of Entries Per Participant

    There is no limit of entries per participant. One entry will be registered for every eligible booking.

    5.5

    Competition Period

    The Competition shall be open for entries from 9:00 Singapore Time on 13 June 2022 to 17:00 Singapore Time on 30 September 2022.

    5.6

    Participation Method

    To enter the Competition, each Participant must book a cruise, a package and or a tour holiday with RCI Travel, RCI 241 and or RCI Exchange during the Competition Period.

    5.7

    Drawing Information

    The draw for the prize will take place on 04th October 2022 via a random electronic drawing process.

    The Winner will be notified by telephone within 24 hours of the draw and in writing.

    If the Prize is unclaimed, an unclaimed prize draw will be conducted at 12pm at 58 Kingston Drive, Gaven, QLD 4212 - 3 days after the original draw date, and the Winner of any unclaimed prize draw will be notified by telephone and in writing within 24 hours of the draw, and the winner will be published on travelmegastore.com.au within 7 days after notifying the winner.

    5.8

    Prize

    1. The prize winner will receive a 12-night cruise to New Zealand onboard Holland America Line’s MS Noordam on a Veranda stateroom type (212-359 sq. ft.). The cruise is round trip Sydney, and will depart on the 2nd of January 2023 and return on the 14th January 2023. This New Zealand Discovery cruise itinerary highlights include a visit to Milford Sound, cruising Fiordland National Park, and ports of call in Dunedin, Wellington, Picton, Napier, Tauranga and Auckland.

    2. All costs associated with or incidental to the Prize, other than the cost of the Prize, are the responsibility of the winner.

    5.9

    Prize Details

    1. The Prize includes:

      1. select onboard main meals (with the exception of those restaurants which have an additional cover charge);

      2. select onboard activities, evening entertainment, and access to nightclubs (with the exception of those activities and facilities which have an additional cover charge); and

      3. taxes, fees and port expenses.

    2. The Prize is subject to availability. If the Prize (or part of the Prize) is unavailable, Holland America Line, at its discretion, reserves the right to substitute the Prize (or that part of the Prize) with a prize to substantially equal value and/or specification, subject to any written directions from a regulatory authority.

    3. All costs associated with transport to/from the departure port will be the responsibility of the winner and will not be borne by the Holland America Line. Pre or post accommodation, shore excursions or other onboard activities, spending money, additional meals, taxes, insurance, passports, visas, vaccinations, transfers, items of a personal nature, in-room charges and all other ancillary costs are not included.

    4. The winner and their companions are responsible for ensuring they have the necessary and valid travel documentation including, passports, any requisite visas and vaccinations. The winner and their travel companions will be responsible for any expenses incurred in obtaining necessary travel documentation, including any fines, or penalties incurred as a result of not having the requisite travel documentation. Itineraries are not guaranteed.

    5. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash. If the winner is, for whatever reason, unable to travel within the nominated period, or does not take an element of the Prize within the time stipulated then that element of the Prize will be forfeited by the winner

    6. In accepting the Prize, the winner agrees to participate in and co-operate with all reasonable media editorial requests by Holland America Line, including but not limited to, being interviewed and photographed, and the winner grants Holland America Line a perpetual and non-exclusive licence to use such footage and photographs in all media worldwide and the winner will not be entitled to any fee for use.

    7. With the exception of the intellectual property rights set out in the Our Vacation Centre’s General and Prize portion of this competition, facilitated by Holland America Line, the winner agrees they will not sell or otherwise provide their story and/or photographs to any media or other organisation.

    8. Standard terms and conditions of travelling with Holland America Line will apply, including any applicable age restrictions and vaccination and testing requirements. See Cruise Contract at https://www.hollandamerica.com/en_US/legal-privacy-australia/cruise-contract.html, which passengers will be bound by.

    9. The winner must provide valid identification to Holland America Line. The winner or their travelling companion must be over the age of 21 years (subject to applicable age restrictions). Alcohol consumption and gambling onboard are restricted to passengers aged 21 years of age or older. A credit card imprint or cash deposit will be required from the winner at check-in in order to board the cruise ship, for all incidental charges.

    10. Holland America Line may require the winner to sign a waiver of liability and indemnity in the form determined by Holland America Line in its absolute discretion.

    11. Holland America Line accepts no responsibility for any tax implications that may arise from the incentive. Independent financial advice should be sought.

    12. As a condition of accepting the Prize, the winner must sign any legal documentation as and, in the form required by Holland America Line in their absolute discretion, including but not limited to a legal release and indemnity form.

    13. Except for any liability that cannot by law be excluded, Holland America Line (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Holland America Line’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) if the cruise is delayed, postponed or cancelled for any reason beyond the reasonable control of Holland America Line; (f) any tax liability incurred by a winner or Entrant; or (g) use of and/or taking of the prize.

    14. Holland America Line collects personal information in order to conduct the competition and administer the Prize and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers and suppliers in the United States and, as required, to regulatory authorities in Australia, New Zealand and the ports of call on the cruise itinerary. Entry is conditional on providing this information. Holland America Line may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the winner in accordance with its Privacy Policy available here: https://www.hollandamerica.com/en_US/legal-privacy-australia/privacy-policy.html. Entrants should direct any request to opt out, access, update or correct information to Holland America Line.

    15. The laws of NSW apply to this promotion to the exclusion of any other law. The winner submits to the exclusive jurisdiction of the courts of NSW.

    5.10

    Winner Notification

    The winners will be contacted, and be notified by e-mail by 04th September.

    5.11

    Publicity

    The winner agrees to, at Organiser’s reasonable request, participate in promotional and publicity activities (such as photography and filming) in connection with the Competition or the winning of the Prize, and the winner consents to Organiser collecting, using, and storing his or her name and images in promotional and publicity materials.

  6. Our Vacation Centre GENERAL TERMS AND CONDITIONS FOR TRAVEL BOOKINGS

    Although Our Vacation Centre (OVC) takes all care in informing members of the most up to date and correct information it remains the responsibility of clients to ensure they are familiar with all terms and conditions relating to individual travel products, passport, visa and immigration issues, health and customs requirements associated with their travel.

    Following is an overview of general items for you to consider in relation to your travel, however the overview may not be absolute in its content and clients must thoroughly check all details in regard to their travel plan. OVC are happy to assist you in regard to any clarifications or other information you require.

    1. It is the responsibility of the client to ensure booking details are correct and all passenger names are correct and match passports. Name changes and booking changes incur penalties and will be required to be paid by the traveller if incorrect information has been supplied to OVC.
    2. Visas and passports are the responsibility of the client. We can assist with this service - fees apply. Please ask your consultant for details.
    3. Passports must be valid for 6 months from return date.
    4. If you are not travelling on an Australian passport, you may require an Australian re-entry visa. This is your responsibility to obtain prior to departure.
    5. All reservations are made in accordance with current schedules. Any change in scheduling or delays and the resulting impact on arrangements are not the responsibility of Our Vacation Centre.
    6. Quotes are valid for 7 days excluding airfares and cruises, which are valid at the time of quoting only. No prices are guaranteed until full payment has been received by Our Vacation Centre.
    7. Credit card surcharges apply, the amounts displayed exclude any credit card merchant fee surcharges. A signed credit card authority form will be required upon booking.
    8. Terms and conditions apply to all bookings. It is the responsibility of the client to request and familiarise themselves with the terms & conditions for their particular travel.
    9. Cruises are subject to availability. Fuel surcharges are levied as per the rules of the individual Cruise line and may be applied at any time prior to sailing.
    10. Your booking may be cancelled if the deposit and/or final payment is not received by the required date stipulated by the supplier or Our Vacation Centre.
    11. All government fees, port charges, surcharges and taxes are subject to change without notice until final payment is made, and documents have been issued.
    12. Cancellation and amendment fees apply to all bookings once a deposit has been received - please see attached fees schedule.
    13. It is the responsibility of the client to ensure they are aware of the latest travel advice issued by the Australian Government and the latest health information for the destinations to which they are travelling.

    14. Our Vacation Centre strongly recommends that clients purchase adequate travel insurance cover for their destinations. Travel Insurance is strongly recommended to be taken at time of booking. Should you decline insurance offered by OVC, we will then require a signed insurance waiver form and be supplied with your current insurance number.

Schedule 1

  1. Eligibility
    1. Directors, officers, management staff, employees and contractors of the Organiser and the immediate family members of these people are ineligible to enter this Competition. “Immediate family member” shall mean spouse, parent, natural or adopted child, or sibling (whether natural or adopted by a parent) of such person.
  2. Competition Period
    1. Directors, officers, management staff, employees and contractors of the Organiser and the immediate family members of these people are ineligible to enter this Competition. “Immediate family member” shall mean spouse, parent, natural or adopted child, or sibling (whether natural or adopted by a parent) of such person.
  3. Rules on Competition Entries
    1. Invalid Entries. In the event that Organiser, in its sole discretion, deems any Competition entry to be invalid, the Organiser may determine a new winner in the same manner set out in clauses Error! Reference source not found. and Error! Reference source not found. of the Summary.
    2. No Amendment of Competition Entry. There shall be no amendment or variation of any Competition entry once such entry is submitted to Organiser.
    3. Originality of Competition Entry. By submitting a Competition entry, such Participant represents, warrants, and undertakes to ensure that the entry is an original work of the Participant. The Organiser reserves the right to verify, or to require the Participant to prove, that the entry is an original work of the Participant. If an entry cannot be verified to the Organiser’s satisfaction, the entry will be deemed invalid and Organiser shall have no further obligation to such Participant.
    4. No Illegal Material. A Competition entry shall not contain any content that:
      1. contravenes any law, regulation, governmental directive, or infringes the rights of any person; or
      2. is otherwise obscene, offensive, potentially defamatory, discriminatory, indecent, objectionable or inappropriate.
    5. No Infringing Material. A Competition entry shall not contain any trade mark, copyright or other intellectual property rights of another person, whether or not the Participant is authorised or licensed to exploit such intellectual property right.
    6. Improper Conduct. The Organiser shall have the right to, in its sole discretion, declare any and all Competition entries made by any Participant to be invalid and prohibit further participation by such Participant in this Competition if the Participant:
      1. disrupts, annoys, harasses or threatens (i) the Organiser or any of its directors, officers, management staff or employees, (ii) any other Participant or potential Participant, or (iii) any person associated with this Competition; or
      2. is subject to any negative publicity that (i) may potentially damage the Organiser’s goodwill or reputation or (ii) is otherwise incompatible with the Organiser’s business.
  4. Licence
    1. Licence Terms. By submitting a Competition entry, Participant irrevocably and unconditionally grants to Organiser a perpetual, fully paid-up, royalty-free, worldwide, transferable, and sub-licensable licence to use, copy, store, reproduce, modify, adapt, make derivative works of, display, publish, distribute, perform, broadcast, communicate, commercialise, and exploit the content and materials submitted as part of the Competition entry for any purpose (including promotional, marketing or publicity purposes).
    2. Waiver of Attribution. Participant irrevocably waives any obligation on the part of Organiser to attribute Participant as the author of the content.
  5. Tax
    1. The winner shall be solely responsible for any tax implications in connection with the Prize.
  6. Liability
    1. No Liability for Entry Errors. Organiser shall have no liability to any person in connection with any lost, delayed, misdirected, undelivered or unreceived entries for whatever reason, including for any technical reason. Proof of delivery of the entry is not proof of receipt by Organiser.
    2. No Liability for Prize. To the maximum extent permitted, Organiser accepts no responsibility for lost, delayed, damaged, undelivered, misdirected, or unreceived Prize. Organiser may, in its sole discretion, re-deliver, re-distribute or retain any undelivered or returned Prize.
    3. No Liability for Competition. To the maximum extent permitted by law, Organiser excludes all liability (including negligence) in respect of any loss, expense, damage, personal injury suffered by any person arising out of or in connection with this Competition, including submitting an entry or using any Prize.
  7. General
    1. English Language Only. These Terms are in the English language only. In the event that any translation of these Terms is provided, such translation shall have no legal effect whatsoever.
    2. Change in Terms. Organiser may, in its sole discretion, amend, modify, or supplement these Terms, and such amendment, modification or supplementation shall be effective immediately upon posting on the Organiser’s website.
    3. Right to Cancel, Suspend or Postpone. In the event that this Competition is cancelled, suspended or postponed for any reason whatsoever, Organiser shall have no further obligation to Participant.
    4. Governing Law. These Terms shall be governed by the laws of Singapore. In the event of any dispute in connection with the Competition, such disputes shall be submitted to the exclusive jurisdiction of the courts of Singapore for final resolution.
